Employees

We work with a variety of different individuals in many sectors at all levels of seniority. Our high profile work includes working with a high level public sector chief executive during a difficult period in her career; negotiating the transfer of a CEO from one major fashion label to another; and managing the departure of a senior executive at a major US tech company. We also work with junior and mid-level staff members addressing issues in the workplace including discrimination, bullying and harassment, redundancy selection processes or advice on settlement agreements.

  • It is becoming increasingly common for employees at all levels of seniority to have their contracts of employment or service agreements reviewed by a lawyer. These documents may contain onerous restrictions on where an employee can work on departure; have contractual language around bonus or incentive award schemes which is at odds with an individual’s expectations; or there may be linked share scheme documentation which deprives an employee or director of hard earned entitlements due to unreasonably drafted contractual language.

Our team of specialists provide advice on these documents promptly and at a reasonable cost by video conferencing or a phone call if this is preferred. Our experience is that signing this sort of documentation with your eyes wide open can save potential issues later on in the employment relationship.

  • The kind of issues we advise individuals on vary hugely: from a troublesome working relationship, to stress at work issues, to being subjected to performance or disciplinary issues. The importance of working with a clearly reasoned and legally sound strategy at these times cannot be over emphasised. Our team prides itself on offering a supportive role as we guide clients through their strategy in a sensitive manner which is tailored to the individual’s goals.

We also provide innovative cost structures to ensure that costs are both affordable and predictable. This allows our clients to effectively budget their costs throughout the process.

  • We regularly provide advice to individuals concerning discrimination in the workplace including race, gender, age and disability. Our team has particular expertise in the area of family friendly rights and we have worked with a number of individuals in this space. Wherever possible we will seek to address these issues sensitively in order to either seek a resolution with the employer or manage a smooth exit for our client on fair and reasonable terms. We will also work with individuals through a litigation process in this legal area, however this will usually be a last resort.

  • Facing dismissal from an organisation, whether for redundancy or another reason can be a very difficult time. Our team will assist individuals with assessing their legal position and developing an effective legal strategy to best achieve their goals.

When an individual is put at risk of redundancy or through a PIP or disciplinary process, dismissal is not necessarily the only possible outcome. With the right strategy in place it can, in certain circumstances, be avoided. We also work with clients who wish to move on from an organisation in these circumstances, helping them to secure a favourable severance package and transition smoothly forward in their career.

At times litigation can be the only option and in these circumstances we will represent individuals throughout the Tribunal process.

  • We are on a number of panels at both large law firms and companies to provide independent settlement agreement advice to individuals who are selected for redundancy as a part of a larger redundancy programme. We also act for individuals in this position on a one off basis. Our work in this area is streamlined to focus on the key issues for the individuals and to seek to ensure our pricing is kept within the budgets set for the job. We have an excellent track record in securing favourable settlement packages for our clients.

  • Disputes with your employer can often be effectively resolved through mediation, allowing for a prompt and cost effective resolution to an otherwise protracted and stressful process.

We have worked with individuals both as a part of private mediations as well as judicial mediations to achieve this very goal, and we have a very strong track record of working with ACAS to obtain a mediated resolution.

  • In circumstances where litigation cannot be avoided our team have a wealth of experience in working with individuals in both Employment Tribunal, EAT and High Court litigation. Our cost planning for these processes is carefully thought out so that clients do not face surprises down the road and we have excellent working relationships with some of the best barristers chambers in the UK to provide reasonably priced advocacy services at all levels.
